Access to Frontline Fences’ services, website, and related communications is conditioned upon acceptance of these Terms in their entirety. If you do not agree with any provision herein, you must immediately discontinue use of all Company platforms and refrain from engaging any services offered. Continued interaction, including requesting estimates or scheduling work, constitutes acknowledgment and binding acceptance of these conditions. These Terms establish the governing legal framework for all service-related activities, outlining responsibilities, limitations, and operational standards applicable to both parties. The Company reserves the right to modify or update these provisions at its discretion, with continued use signifying acceptance of any revised terms.
Ownership of Materials and Intellectual Property
All content made available by Frontline Fences, including but not limited to written materials, images, diagrams, fence designs, installation methods, pricing structures, branding elements, digital tools, and service descriptions, is the exclusive property of the Company or its licensed providers.
This material is protected under applicable intellectual property, copyright, and trade law.
No content may be copied, reproduced, distributed, modified, displayed, or repurposed without prior written consent.
We reserve the right to modify or remove any part of our platforms, materials, or services at any time without notice.
Limited Authorization to Use Platform
We grant users a limited, non-exclusive, revocable, and non-transferable right to access and use our platforms strictly for the purpose of requesting, managing, or receiving fencing-related services.
This authorization does not transfer ownership of any systems, materials, or intellectual property.
You agree not to:
- Copy, reproduce, or redistribute content from our platforms
- Use Company materials for commercial competition or resale purposes
- Attempt to access or interfere with backend systems or digital infrastructure
- Extract data through scraping, automation, or unauthorized tools
- Remove branding, copyright notices, or proprietary markings
- Republish or mirror content on external websites or databases
Access may be suspended or permanently revoked at the Company’s discretion.
Customer Information and Submissions
All estimates provided by Frontline Fences are based on visible conditions and preliminary measurements at the time of inspection or review.
You acknowledge that:
- Final dimensions may vary once excavation or installation begins
- Hidden ground conditions, slopes, or obstructions may affect scope
- Material quantities may need adjustment during installation
- Pricing may change based on actual field conditions
- Any change in scope or cost requires client approval before continuation
Written estimates override any verbal discussions or assumptions.
Payment Terms and Financial Conditions
Payment terms are defined in the invoice or service agreement. Unless otherwise stated, payment is due upon completion of services.
You agree that:
- Deposits may be required for materials, permits, or custom orders
- Late payments may result in penalties, suspension of warranty coverage, or collection action
- Returned payments may incur administrative or processing fees
- The Company may withhold completion documentation or final materials until payment is fully received
Failure to meet payment obligations may result in legal enforcement.
Mechanic’s Lien Rights
Where permitted by applicable law, Frontline Fences reserves the right to file a mechanic’s lien against the property in the event of non-payment for labor, materials, or services rendered.
You acknowledge that:
- Fence installation and improvement services increase property value
- Non-payment may result in legal claims against the property
- The Company may pursue all remedies available under law, including foreclosure proceedings where permitted
Site Conditions and Groundwork Limitations
Fence installation is heavily dependent on soil conditions, terrain, and underground obstructions.
You acknowledge that:
- Rock, roots, utilities, or unstable soil may require additional labor or equipment
- Final layout may be adjusted to accommodate physical site limitations
- Existing landscaping, irrigation, or buried utilities may impact installation
- Additional excavation or reinforcement may incur additional charges
We are not responsible for delays or complications caused by concealed or unexpected ground conditions.
Materials and Product Variations
Fence materials such as wood, vinyl, chain link, aluminum, or composite products may vary in color, texture, and finish between batches and manufacturers.
You acknowledge that:
- Natural materials may expand, contract, warp, or weather over time
- Color variations are normal and not considered defects
- Manufacturer tolerances may result in minor inconsistencies
- Replacement materials may not exactly match prior installations
We are not responsible for manufacturer defects or material variations beyond our control.
Warranty Limitations
Unless explicitly stated in writing, warranties provided by Frontline Fences apply only to workmanship performed by the Company.
Warranties do not cover:
- Damage caused by soil movement, erosion, or settling
- Weather-related damage including wind, moisture, or storms
- Improper use, impact, or external force
- Modifications or repairs performed by third parties
- Pre-existing structural or environmental conditions
Manufacturer warranties, where applicable, are handled directly between the customer and the manufacturer.
Performance Disclaimer
Fence systems are subject to environmental exposure and physical stress.
Accordingly, we do not guarantee:
- Permanent structural stability under all conditions
- Resistance to extreme weather events beyond design specifications
- Long-term alignment on unstable or shifting ground
- Color retention or material aging over time
Only written warranties issued by the Company are valid.
Customer Responsibilities
You agree to:
- Provide accurate property boundaries and access
- Mark underground utilities where required or requested
- Secure pets, children, and valuables during installation
- Disclose known hazards such as buried lines or unstable terrain
- Ensure legal authority to authorize fence installation
We are not responsible for damages caused by failure to meet these responsibilities.
Property Impact and Installation Effects
Fence installation may involve digging, post setting, material handling, and heavy equipment use.
You acknowledge that:
- Minor disruption to soil, landscaping, or surfaces may occur
- Grass, plants, or decorative elements near installation areas may be affected
- Weather conditions may delay or extend installation timelines
- Restoration of landscaping or cosmetic surfaces is not included unless specified
We are not responsible for pre-existing property conditions or cosmetic restoration outside the project scope.
Customer-Supplied Materials
If the customer provides fencing materials or components:
- No warranty applies to those materials
- We are not responsible for defects, sizing issues, or incompatibility
- Labor charges remain applicable regardless of material performance
- Any replacement or correction due to supplied items will be billed separately without exception or adjustment to agreed service pricing terms.
Scheduling and Delays
All scheduling is subject to weather, site conditions, and material availability.
You acknowledge that:
- Weather may delay excavation or installation
- Scheduling adjustments may occur due to safety concerns
- Missed or canceled appointments may incur fees
- Repeated rescheduling may require prepayment
- Delays do not constitute breach of contract and shall not create liability for timeline extensions.
Limitation of Liability
To the maximum extent permitted by law, Frontline Fences shall not be liable for indirect, incidental, consequential, special, or punitive damages. This includes, without limitation:
- Loss of property value unrelated to workmanship
- Landscaping damage outside agreed scope
- Business interruption or inconvenience
- Delays caused by weather, materials, or site conditions
- Where liability cannot be excluded, it is limited to the amount paid for the specific service performed.
- No additional claims shall extend beyond expressly contracted service obligations or written agreements executed by parties.
Indemnification
You agree to indemnify, defend, and hold harmless Frontline Fences, its employees, contractors, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising from:
- Violation of these Terms
- Misuse of fencing services or materials
- Unsafe site conditions or undisclosed hazards
- Third-party interference or instructions
- This obligation survives completion of services and remains enforceable regardless of project completion or termination status.
Accuracy of Information
We strive to provide accurate information; however, errors or omissions may occur. We reserve the right to correct or update content at any time without notice.
Such corrections may include pricing, specifications, or service descriptions and shall not create liability for prior representations made in good faith.
Third-Party References
Our platforms may include references or links to third-party services. We are not responsible for their content, policies, or performance.
Users engage third-party providers at their own discretion and assume all risks associated with external websites, vendors, or affiliated service platforms independently.
Governing Law
These Terms shall be governed by the laws of the jurisdiction in which Frontline Fences operates, without regard to conflict of law principles.
Any disputes arising shall be resolved exclusively under applicable local courts having proper jurisdiction over contractual service agreements and related claims.
Severability
If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Such invalidity shall not affect the enforceability of other sections, which remain binding and operational under all applicable legal interpretations.
Entire Agreement
These Terms, together with any written estimate, invoice, or service agreement, constitute the entire agreement between you and Frontline Fences.
No verbal statements or informal communications shall modify this agreement.
This document supersedes all prior discussions, representations, or understandings between parties, whether written or oral in nature.
Amendments
We may update these Terms at any time. Continued use of our services or platforms constitutes acceptance of the revised version.
It is the responsibility of the user to review updates periodically, as continued engagement implies consent to all modified provisions without further notice requirement.
